First Day – Activity of Memorandum Submission as per call of AIGETOA Notice and Meeting with Director HR today:

Management invited the delegation of AIGETOA for discussion on the notice points. Team AIGETOA comprising of Shri Ravi Shil Verma AIC, Shri Veerabhadra Rao AIP, Shri Wasi Ahmad GS, Shri Badri Mehta FS, Shri Pavan Akhand Dy GS, Shri Vivek Kumar Singh AGS, Shri Sunil Gautam AGS and Shri P N Sharma attended the meeting with Dir HR and PGM SR on 14.07.2022.

Meeting started with firm demands and strong argument of the association with DIR HR on MT and other HR issues, where team AIGETOA explained each issue and expectation of Executive fraternity from BSNL Management on HR issues which were circulated through agitation notice. Meeting continued for nearly two hours.

Issue wise update is as follows.

Std pay scale issue:

DIR HR appreciated the concern and assured to take up the issue immediately with DoT. Association representatives requested management to inform DOT in clear terms that there is no cascading effect and only initial two scales of JTO/JAO and SDE/AO and equivalent grades are to be replaced. Director HR assured for the same and informed that they shall be taking the matter with DoT immediately. Director HR also scheduled an exclusive meeting on pay scales and pay loss related issues on 15th July 2022 wherein PGM Establishment and other related officials will remain present to finalize the way forward and next course of action to resolve this long pending issue.

Pay loss Issue:

AIGETOA requested DIR HR to instruct the committee formed for pay loss issue to revisit 22820 issue and find out way to resolve the same and submit the recommendations.

Further, the association also requested DIR HR for the formation of Committee for E1+5 and DR JE to JTO pay loss issue.

Director HR assured to look into the issue as suggested by the association. These issues shall also be discussed in the exclusive meeting on 15th July 2022.

Immediate termination of MT internal recruitment process:

Association categorically informed that any discussion on amicable resolution of issues shall take place only if the current MT Recruitment process is immediately put on hold and MTRRs are scrapped. After lots of discussion and deliberation on the issue, Dir HR finally agreed to address the concerns raised by the association and assured to take necessary action in this regard. We made our point very clear that only assurance will not work and an immediate necessary action should be taken to restore the confidence of Executives.

AGM Promotion:

After detailed discussion and facts presented by AIGETOA team to ensure the utilisation of complete strength of AGM plus DGM strength combined together. We stated that there is precedence in past and all the AGMs who are working as DGM Adhoc and LA may be considered as occupying regular posts and hence these vacancies can also be used for promotions. DIR HR convinced to consider our inputs and ensure promotions from SDE to AGM very shortly. We also requested for initiating the discussion on new MS RRs containing stagnation criteria and fast track promotion mechanism and provisions to be made for the fast track promotions till GM grade. Director HR assured that formal discussions with AIGETOA in this regard shall be initiated soon.

Promotion of AO to CAO and AGM to DGM Regular:

On CAO promotion, DIR HR informed team AIGETOA to wait till the next date of hearing i.e. 23rd Aug 2022 of Hon’ble Chandigarh CAT. Decision will be taken thereafter. We emphasized upon relaxation of 15-16 days in the cut off and ensure the filling up of all vacancies of CAO cadre. Discussion on AGM to DGM grade promotions shall also be held shortly wherein we emphasised that all adhoc DGMs may be made regular DGMs and also AGMs who have completed their residency period of 4 years may be extended regular promotions by considering relaxation of six months in cut off date as all working AGMs have completed their 4 years residency in the grade and there are sufficient vacancies in DGM cadre.

DPC of leftout JTO of 2008 batch

As agreed earlier, DIR HR again re confirmed that, DPC process of left out JTOs of 2008 batch will be initiated immediately after the notifications of SDE RR or SDE to AGM Promotions which ever is earlier. He also assured to pursue with DOT for their reply on pensionary implications of the new SDE RR. It will be pertinent to inform all that after rigorous pursuasion by AIGETOA, board has authorised CMD and Management Committee of the Board to consider relaxation in the Stagnation period of 12 years.

Enhancement of SAB to 30%

As presented by Association, DIR HR agreed to discuss with CMD for the Enhancement of SAB contribution.

Deposit of pending SAB contribution.

Dir HR assured to deposit pending contribution at the earliest and also assured that matter will be taken up with Finance wing to ensure regular deposit of monthly SAB subscription so that arrears may not increase cumulatively.

SDE reversal issue

As agreed earlier, DIR HR assured that the final settlement of SDE reversal issue shall be done immediately. In the meeting, association demanded to issue the minutes on the points agreement reached and also start working on the assurances immediately. However till late night, minutes were not released and concrete action on the assurances is yet to be seen.

The memorandum submission was observed in the afternoon. Director HR personally came to the ground floor of BSNL corporate office and addressed the assembled gathering and received memorandum. He assured all present in the gathering that long discussion and deliberations have been done with AIGETOA representatives and assured that commitments shall be honoured and results will also be visible soon.

It’s a failure of management to handle the pending HR issues despite several assurances made in past and we see it as a deliberate attempt to create unrest in the organisation by ignoring Career Progression and Pay Pension related issues.

The consistent Saga of BSNL Management to fail the career of Executives to prevent them from reaching higher posts :

BSNL Management has completely failed to meet the minimum Career Aspiration of Executives, where one has to wait endlessly to reach next level of promotion. If we see the residency period of JTO/JAO for next promotion is just 3 three Years but people are getting promoted through normal rout of DPC in 15-20 years. Similarly for AGM/CAO equivalent grade the residency period in preceding grade is just seven years but people are waiting for promotion from 9-18 years. This shows that HR has taken a complete back seat in BSNL and management has completely neglected this part of an organization. Now, they are desperately trying to start a lateral entry on the name of Management Trainee which will permanently kill the remaining opportunities for the Executives.

Hence, AIGETOA has served a Notice for Organizational Call to lodge our strong protest. We call upon all Executives to support the call irrespective of the affiliate to any associations or not.

All CHQ OBs must reach BSNL CO 14th July to submit memorandum to CMD/Director HR in person and stay back at Delhi till resolution of issues.

AIGETOA Served Notice for Organisational Call for settlement:

AIGETOA served Notice for Organisational Call in view of Complete Breach of Trust, Non redressal of burning HR issues including Standard Pay Scale E2-E3 & Pay Loss Issues, Non issuance of Promotion in AGM/CAO Equivalent Grades despite the verdict of Hon’ble Supreme Court, Non notification of SDE/AO Equivalent Grades RR, No headway on Revision in MS RR, Non Settlement of SDE Reversal Issue, Pending Superannuation Benefit (SAB) Quantum and amount, Scrapping of MT RR/DR DGM RR and replacement with Fast Track Promotional Methodology and resolving of our legitimate issues.

Earlier, an emergency meeting of Central Governing Body, Circle Secretaries and Circle Presidents of AIGETOA held on 09.07.2022 to deliberate and decide course of action on continued negligence by management in resolving outstanding legitimate HR issues pertains to the BSNL Executives and felt that management is totally non committal and no progress has been made on several important issues. It is observed that the association has always honoured the appeal of management and withdrawn call on previous occasions on the assurances and agreement reached, which were even released through above minutes but it is very unfortunate that management has gone back from its own promises resulting in the persistence of almost all issues.

About 13000 executives recruited/promoted by BSNL from 2009 to 2020 are suffering with severe losses in their total emoluments due to non approval of Standard Scale of E2-E3 Scale, which is a residual of 2nd PRC in BSNL. It is important to note that one hand about 30K BSNL Executives (whose last pay revision made on 01.01.2007) are struggling with Pay Issues and denying all legitimate dues on the name of financial crunch and other side senior managers are enjoying all Pay & Perks of 7th Pay Revision w.e.f. 01.01.2016 in same BSNL– It’s an Extreme Injustice as Equal Treatment Not Extended.

one side management is sitting on AGM/CAO Promotions of those executives working in preceding grade from 9-18 years despite of DOPT Order, while other side it took just 2-3 hours for the management to declare the results of MT Internal late night and no legal opinion, no consideration from any of the welfare organization etc was ever sought for as being asked in case of AGM/CAO Promotions in BSNL. Similarly, despite written assurance by the Dir(HR) for settlement of SDE Reversal issue, there is no takers in the system and issue is lingering since more than 2 years of its commitment and candidates are suffering enormously due to the fault of BSNL.

Finally after all deliberations, it is concluded that our all efforts to break the stalemate through dialogue is futile and our patience for getting resolution through amicable means has totally gone away as management has failed to keep their own words. Sensing no hope for any amicable resolution, participants of the CHQ-CS-CP Meet has decided to serve Organisational Call Notice for settlement of the long outstanding issues as listed below.

:DEMANDS:

  1. Immediate intervention of the Dir HR/CMD with DoT for the approval of E2-E3 Scale meant for the JTO/JAO and SDE/AO Equivalent Grades. The revised presidential order for replacement of initial two scales of JTO/JAO/Equivalent by E2 and SDE/AO/Equivalent by E3 should be ensured immediately by BSNL Management.
  2. Settlement of Pay Loss issues of JTOs/JAOs (E1+5 and 22820/- and Pay fixation of DR JE to JTO) to extend immediate relief.
  3. Immediate termination of MT Internal Process re-initiated on 08.07.2022 and altogether Scrapping of MT and DGM RRs and replacement with internal fast track promotional methodology as stated by CMD BSNL and approved by BSNL Board in Restructuring in Nov-2021.
  4. Issuance of AGM Promotions for All Eligible Executives by utilising complete strength of AGM and DGM Grades in one go and by further increase in the sanctioned strength of various grades and streams in view of takeover of complete O&M works of BBNL/MTNL by BSNL.
  5. Issuance of Promotion in the AO to CAO and other equivalent grades and regular promotions in the grade of DGMs.
  6. DPC Promotion for left out JTOs of 2K8 batch and subsequent JTO batches, Notifications of SDE/AO Equivalent RRs and notification of LDCE for the SDET/AO Equivalent Grades for all vacancy years.
  7. Enhancement of total SAB to 30% (shortage of 8.2%) and formation of PRMB Trust with defined contribution. Deposit of pending SAB amount (due since April-2021) with interest.
  8. Onetime settlement of LDCE-2007 SDE Reversion issue as assured in 1st Agenda Meeting.

  • 18th July-2022 – Submission of Memorandum to CGM by Circle & District OBs and Gate Meeting at All Circle HQs.
  • 20th July-2022 – Lunch Hour Demonstration at Central/Circle/BA HQ & Twitter Campaign.
  • 25th July-2022 – Delhi Chalo for Indefinite Dharna at BSNL CO, New Delhi for settlement of issues.

All our OBs and Members are requested to give a wide publicity to the program and ensure for its success to vent your resentment as expressed from time to time. AIGETOA sincerely believes and quite hopeful that management will seize the opportunity to address the lost trust and ensure immediate settlement of our long pending issues and address our serious concerns as stated above to maintain Employees- Employer relationship healthy and employees in motivated state for higher growth of the organisation.

Protest lodged by Team AIGETOA in front of BSNL BoD in a unique manner on 23rd June 2022:

The continued stalemate of the SDE to AGM and AO to CAO Promotion despite the pronouncement of judgment by the Hon’ble Supreme Court of India and Executive Instruction by DOP&T on the matter of Reservation in Promotion has fuelled the anger to its peak. The matter was deliberated in the recently concluded CEC of the AIGEOTA CHQ on 22.06.2022 at New Delhi. The management is not trying to understand the woes of executives, who are waiting for promotions since years together in absence of any Promotion in the grades of AGM/CAO since 2018. These grades are in acute shortage after VRS in January ‘2020 but still management is not ready to break the deadlock and depriving the much awaited promotion, which is not only the need of the Executives but for the organization equally. A unique protest was organized by AIGETOA to highlight the cause of the SDEs/AOs waiting for the AGM/CAO Promotions. We call upon all Executives to lend your support to AIGETOA to raise and fight for each and every issue of executive genuinely.

Team AIGETOA comprising of CHQ Body and some OBs/Members of BSNL Corporate Office displayed play card and offered rose to Hon’ble CMD and other functional Directors of BSNL Board on 23.06.2022 before the Management Committee Meet to convey the severe resentment and anguish prevailing in the field on the continued impasse on AGM/ CAO Promotion. After conveying the anger and sufferings of people to the CMD BSNL, the gathering went to the chamber of the Director HR and handed over the rose to him also and appraised continued standoff on the matter. This is causing serious demotivation, despair and pain in the minds of the executives, who is not leaving any stone unturned for the welfare of the organization and whose best example is that no degradation of service felt despite the curtailment of more than 50% on roll employees through VRS and stiff financial embargo in 2020 and 2021, where even the fund for maintenance were not available and salary was delayed by 1 to 1.5 months. It was also highlighted that how the seniority of SDEs have been lowered by changing its own decision by the BSNL management putting the meritorious LDCE qualified Executives most disadvantageous position and this must be addressed by executing promotions to all SDEs completed their residency period by readjusting the vacancies.

Director HR gave a patient hearing to the gathering and agreed with the concerns raised by association and assured to expedite the efforts to break the deadlock on the AGM/CAO Promotion. Association clearly appraised that the patience is running out and the management should take necessary action to issue Promotions else the continued neglect may result in serious breach of peace of the organization.

Deferment of 20-30th June’2022 scheduled Pad Yatra Program in view of Dhara-144 and prevailing violent situation in the route:

The Pad Yatra was scheduled to be held from Chandigarh to Delhi from 20-30th June’2022 to pay tribute to the departed soul of Late Shri Vijay Kumar Bansal Ji and raise the issue of Social Security to BSNL Recruited Employees. Intimation cum permission for the proposed program was already sent to the Police Team of Chandigarh Haryana and Delhi and all preparations were in full swing for the proposed Pad Yatra Program by the Team AIGETOA.

In the meantime sudden outbreak of violent protest on Agniveer Issue at various places including the route of the Pad Yatra and serious apprehension of further flare-up in the situation in the route and implementation of Dhara-144 at various places forced us to review the situation. The Police also didn’t give the permission for the Pad Yatra Program in view of the prevailing situation. The views of other stake holders including the participants of Pad Yatra were also taken and entire situation was assessed. After reviewing the complete situation in all perspective, we have decided to defer the proposed Pad Yatra Program presently and further decision will be taken subsequently.

Call Attention Program Full 30% Superannuation Benefits w.e.f. 01.01.2007, Compensatory Ground Appointment (CGA) and immediate monetary relief to families of the deceased BR Employees

AIGETOA CHQ pays its tribute to Late Shri Vijay Kumar Bansal SDE ITPC Chandigarh and vows to carry forward the fight of Proper Social Security Cover of BSNL Recruited Employees to the highest Echelons of Management and apprise the Desperate, Vulnerable and Hopeless situation of the Families of Deceased Employees Recruited by BSNL due to pathetic condition of the ‘Superannuation Benefit Pension Mechanism’ and absence of any other support like CGA/Monetary Support etc. This has lead to the precarious situation to many families of BSNL, after the sole bread winner met any eventuality during the service period. It’s the duty of all of us to Ask for Justice for such families and fulfills our obligation towards our colleagues and their families.

For understanding the issue, we can broadly classify the employees working in BSNL in three Major Categories as detailed:

  1. Employees absorbed from the DoT, Govt of India and working on regular roll of BSNL. These employees covered through government pension through a special provision of Rule-37A. In the event of superannuation/ retirement or unfortunate demise during the service, the family is entitled for the Govt Pension and well protected financially.
  2. Employees working on deputation in BSNL and not on regular roll. They can go to their parent government organisation at any point of time and fully covered through Government Pension and entitled benefits.
  3. The last sets of Employees are those recruited by BSNL both in Executives and Non-Executives categories. This set of Employees doesn’t have Govt Pension and their Social Security is covered through half cooked Superannuation Benefit (SAB) Scheme of 2nd PRC only. BSNL Gazette Notification states to create a Pension Mechanism for BSNL Recruited Employees and 2nd PRC recommended for 30% defined contribution under SAB w.e.f. 01.01.2007 comprising of EPF, Gratuity, PRMB and SAB Pension Fund. But despite of these provisions, BSNL Recruited Employees are getting only EPF-12%, 3% under SAB Pension Fund w.e.f 04.05.2016 which was enhanced to 5% w.e.f 01.04.2017 and 4.8% under Gratuity, which total for 21.8% defined contribution against 30%, a shortfall of 8.2% in quantum and 10 years in the period of implementation w.e.f. 01.01.2007. Whereas the BSNL Gazette Notification provision for Pension since the date of inception of BSNL remained a Non-Starter.

Even the existing 5% SAB Pension Fund, which is managed by LIC, has a backlog of payment causing recurring loss of interest for the delayed payment. As on date the SAB Pension Fund has been cleared only upto March-2021 and more than one year contribution of more than 150 Cr is pending at the end of BSNL.

The above reasons have created a completely insecure situation and acute hardship to the families in case of any eventuality to their sole bread winner and employee recruited by BSNL, a 100% Govt owned CPSE. The only recurring support is coming in the range of Rs 2000-2500 from the existing SAB Pension Fund and similar amount through EPS-1995 provision under EPF. One can understand the suffering of a family and the acute difficulty in managing the household, education and medical in such a peanut amount in case of any sad demise of the employees, when the whole responsibility is pending due to younger age. This is a complete discrimination among various sets of Employees in BSNL and must be raised to resolve the issue relates with humanity. In view of the said precarious situation of BSNL Recruited Executives and Employees, the association has decided to press for their issue by demanding full Social Security Cover and holding various programs to highlight the Cause. All are request to extend their full support.

DEMANDS

  • Extending Pensionary Benefits to all BSNL Recruits from the date of their joining of service in line with the provisions extended by Government of India while corporatizing the Telecom Operations Part of DoT in the name of BSNL.
  • Extend Full 30% SAB as defined Contribution to BSNL Recruits in line with the DPE guidelines of 2nd PRC by enhancing Quantum of SAB w.e.f. 01.01.2007 (Presently Shortfall in SAB is 8.2%). Immediate deposit of full outstanding amount of the ongoing fund with interest.
  • Restoring CGA appointments in BSNL and making necessary changes in the CGA policy to bring families of deceased BSNL Recruits in the ambit and make them eligible for CGA appointments.
  • Extending immediate monetary relief to families of the deceased BSNL Recruited employees.
