Clarification on the
Rajasthan High Court Case and LDCE Posting
Dear friends,
It is being spread by some peoples that why AIGETOA has
not given undertaking so for to keep continuing the posting of LDCE. I want to
clarify,
That, no final format has been given to us for the undertaking so for, as was committed by the personnel section to give the final format after consultation with the legal cell. I spoke to the ADG (Pers) today about the format of undertaking, she clearly said that format has been sent to legal cell but no final approval is received so far and it will take one or two days.
It is not the
matter to give any undertaking or affidavit by GS, AIGETOA and GS has not made
any commitment to give any undertaking even it will not make any meaning. It
is the matter of petitioners only and they will also take the legal opinion on
the format received. AIGETOA has already clarified the case to the management.
Details of the case:
Rajasthan court case was filed on 10/07/2007 just before the LDCE examination with active support and suggestion received from all over India.
This case is basically based on the seniority issue of promotee and direct recruitee JTOs. Many JTOs who, were promoted after us and even they do not possess the requisite qualification of JTO Group –B (Executive) as per the recruitment rule of 1999/2001 but awarded retrospective seniority in the gradation list and placed above and before us. We have received Stay order in the Aug 07 as interim relief for the following true prayer:
“It is respectfully prayed that the respondents be
restrained to operate upon the seniority list under challenge for the purpose of
promotion and by suitable order the respondents be restrained to promote
erstwhile Junior Telecom Officers Gazetted Group-B post to the post of
Sub-Divisional Engineer by any mode of promotion till they possess qualification
as amended in the year 1999 and 2001 till the final disposal of the writ
petition”.
Aforesaid prayer clearly says that, the person who does
not possess the requisite qualification and other eligibility of JTO recruitment
rule 1999/2001 be restraining to get promotion and respondents be restrained to
operate upon the seniority list till the final disposal of the case.
Despite of this clear fact, the management has stopped the LDCE posting but
operated the seniority cum fitness two times after the stay order with the
intension to dilute the case.
I have received various inputs from the members, even some of them are
threatening to leave the association and form another association of LDCE
qualified people.
I would
like to say some words for such peoples:
Rajasthan team who had filed the case, were appreciated by
every members at that time. I have several mails before the LDCE to stop the
examination and file the case and even many circles had file the case on LDCE.
Now the same team who have receive the appreciation earlier is now receiving
threatening call by the same peoples. This shows the opportunistic nature of the
peoples. Despite of this fact, they are threatening and blackmailing to leave
the association. I would like to request all of them to immediate leave
the association because we are not in need of such type of people and they are
free to leave and just fight for continuing the process of LDCE posting only.
This case was filed to safeguard the aspiration of our cadre not for the chunk of people so, there is no question to give any undertaking or affidavits which ultimately dilute the case. As all the promotions from JTOs to SDEs are stopped while other promotion is continue and all the members who have qualified the LDCE are already eligible for time bound scale of the SDE. so, they are not going to bear any loss if LDCE remains held up for some time. This is also fact that SDE will be eligible for next promotion after passing minimum six years regular service but data says that no one has got next promotion in six years only; it takes more then 10 to 15 years, so if the LDCE posting will be delayed (while we are trying to find the way) there is no loss for the next promotion also.
There is one loss to the people who are seeking inter
circle transfer and hoping to get transfer to their home circle on the basis of
LDCE posting but at the same it is also true that many of them will be displaced
from the choice of place or from their circle. Management has already prepared
the list of hard tenure posting of our peoples we need some time and force to
stop this movement else they will be most sufferer.
All theses mean to say that, while we are trying our best to keep continue the
LDCE posting but at the same time we can not compromise the basic motto of our
association. I have gone through the entire petition and I can say this case can
lead us towards the separate cadre by making our separate seniority list.
Other fact of the members
After taking the charge pf GS I initiated the signature
campaigning for no MT above then GE JTOs but received very disappointing
response.
I initiated the "calling request" for inter circle transfer; I received response beyond my expectation.
I called the list of members of the circles, I received no response.
I called the proposal for AIC, I received no response.
I called the CHQ and active members to participate for the agenda meeting, I received shameful response.
I did not make any request for LDCE posting, but I received response with messages and calls.
All these shows that, members are very much active but for their own reason and not for the cadre. They always expect the things from others which they won’t give at any cost.
